United States: USCIS to Begin Adjudicating Premium Processed H-1B Cap Cases on May 12

Initial adjudication of premium processed H-1B cap cases should be completed by May 27 - slightly earlier than USCIS's initial projections.

USCIS will begin to adjudicate H-1B cap cases filed under premium processing on May 12, it announced today - four days earlier than projected.


Employers whose premium cases were selected in the H-1B cap lotteries should see initial action of their cases - either an approval, a request for evidence (RFE) or, in some cases, a denial - by May 27.

What's Next for Premium and Non-Premium Cap Cases


Email receipting of premium processing cases selected in the lottery appears to have been largely completed. Employers have begun receiving paper receipts for premium processed cases.

Non-premium receipting is expected to begin shortly and continue for at least several weeks. Cases not chosen in the lottery will be returned with their filing fees; this is likely to begin in mid- to late-June.
