United Kingdom: Third Party Sites May Now Be Visited During Compliance Audits
Further to the Immigration Rules changes that took effect April 6, 2017, UK Visa and Immigration can now conduct an audit at any UK address where sponsored workers carry out their work, including a third party's premises, such as a client site where work is conducted under a contract for services.
The guidance also stipulates that it is the sponsoring employer's
responsibility to ensure the full cooperation of the third party during
the site visit.
What This Means for Employers
This is a major change in policy, and sponsors will need to discuss the
possibility of UKVI audits with their clients. Fragomen can assist clients with
the audit process.
Fragomen is considering the full implications of this change and will provide
further information.
The above guidance should be reviewed in line with other non-immigration-related
requirements imposed on UK employers.
