Romania: Strict Enforcement of Minimum Salary Level Requirements
Following an increase to the minimum salary level (MSL) in February 2017, from RON 2,681 to RON 3,131 per month, the Romanian authorities have recently begun enforcing this requirement more strictly. This increased enforcement is primarily evident in its effect on new and renewal Residence Permit applications and the increased risk during inspections by labor authorities.
The immigration authorities will not issue or extend Residence Permits for foreign nationals who do not meet the new MSL requirements. As such, employers that have not yet adjusted the salaries of foreign national employees in line with the new MSL requirements must do so prior to submitting any new or renewal Residence Permit applications.
Furthermore, in the event of an inspection by labor authorities, the right of stay may be revoked for foreign national employees whose salaries do not meet the MSL requirements.
For foreign nationals with accompanying dependents, the MSL must be increased by RON 1,450 per accompanying dependent. However, bank statements showing the required amount are also accepted to prove means of support for accompanying dependents.

Employers should ensure that the salaries of foreign national employees meet the minimum salary level requirements to be compliant with the regulations and to maintain Residence Permits for foreign nationals.
