Canada: Labour Market Impact Assessment Applications to be Subject to Expanded Advertising Requirements

Effective August 28, 2017, the requirement for employers filing Labour Market Impact Assessment (LMIA) applications to a) advertise on Canada's Job Bank; b) conduct at least two additional methods of recruitment; and c) use the Job Match service prior to filing an LMIA application will be extended to all Canadian provinces and territories.

Effective August 28, 2017, the requirement for employers filing Labour Market Impact Assessment (LMIA) applications to a) advertise on Canada's Job Bank; b) conduct at least two additional methods of recruitment; and c) use the Job Match service prior to filing an LMIA application will be extended to all Canadian provinces and territories. 

Job Bank Advertising Requirement Expansion
The requirement to advertise on Canada's Job Bank and conduct at least two additional methods of recruitment will be extended to all provinces and territories in Canada. Employers from a province or territory with a provincial/territorial job board will have to also use Canada's Job Bank. They may also use their provincial or territorial job board as one of the additional recruitment methods.

Job Match Service Requirement Expansion
The Job Match service requirement - which will also be extended to all employers - grants employers the ability to view anonymous profiles of registered Job Bank users which match the skills and requirements listed in their job posting.  Matches are rated using a star system of one to five. The more stars a match receives, the greater the compatibility between the job seeker and the advertised position.

  • Employers seeking to fill a high-wage position must invite candidates with scores of four stars or more to apply for the position. This must be done within the first month (30 days) of the job advertisement on Job Bank.
  • Employers seeking to fill a low-wage position must invite candidates with scores of two stars or more to apply for the position. This must be done within the first month (30 days) of the job advertisement on Job Bank.

What This Means for Employers and Registered Job Bank Candidates
On or after August 28, 2017, more employers will become subject to Job Bank advertising and the Job Match service requirement since these rules will be extended across all of Canada.
