The situation
As projected, effective January 1, 2018, the minimum salary level will be increased from RON 1,450 per month to RON 1,900 per month.

Impact

  • Initial applications. Employers seeking to sponsor foreign workers on or after January 1, 2018 must ensure the employee's salary level meets the new minimum monthly salary requirement.
  • Pending applications. Employers of foreign workers with pending applications on January 1, 2018 must raise the employee's salary level if the employment or assignment start date falls on or after January 1, 2018.

Additional requirements

  • Benefits and allowances. Benefits and allowances may only be included if they are specified in the employment contract, guaranteed and fixed, and are not paid in kind. Holiday allowance cannot be included; a thirteenth month can be included.
  • Market salary rate. Salaries must also meet the market salary rate for the proposed position.
  • Currency. Employers are required to guarantee the salary in RON regardless of payroll location and/or exchange rate fluctuations.
