SPAIN'S"LAW OF GRANDCHILDREN": PATH TO SPANISH NATIONALITY AND DEMOCRATIC MEMORY
The Law of Democratic Memory in Spain, commonly known as the "Law of Grandchildren," received official approval on October 21, 2022, and became effective on the day following its publication.
This law offers an opportunity for Spanish nationality application to the following categories of individuals:
-
Those born outside of Spain to a father, mother, grandfather, or grandmother who was originally Spanish but lost or renounced their Spanish nationality due to political, ideological, religious, or sexual orientation reasons, resulting in their exile. To establish the exile, there is a presumption that individuals who traveled outside of Spain between July 18, 1936, and December 31, 1955, are considered exiles. If the departure occurred after this date, evidence of exile must be provided.
-
Children born abroad to Spanish women who lost their nationality by marrying foreigners before the enactment of the 1978 Constitution.
-
Adult children of Spanish citizens whose original nationality was recognized through the right of option as outlined in the present law.
It's important to note that there is no age limit for applicants under the new Law.
However, individuals interested in obtaining Spanish nationality have a two-year window to initiate the application process, starting from October 21, 2022, with the possibility of extending it for an additional year.
