We just wrapped up another successful FEM Boston session. This is the fifth time we have done the “Annual Immigration and Expatriate Tax Update” and always well attended and received. However, this is the FIRST time we have been left with more questions than answers. That of course has to do with the massive uncertainty the new administration is bringing. What have we learned so far?

Here are some thoughts from Scott Fitzgerald of Fragomen Worldwide in Boston.

  1. The effect of the Trump administration's recent Executive Orders relating to US immigration continues to evolve. Please keep a close eye on additional developments regarding these Executive Orders, as we anticipate additional restrictive policies to be forthcoming. We will be pleased to add any of the attendees to our "Client Alert" list if helpful.
  2. We also anticipate that immigration enforcement, not only against those who are in the US without status, but also targeting employers who legally sponsor and employ foreign nationals in professional positions within their companies, will increase substantially. We believe that it is critical for employers to ensure that their immigration compliance efforts (e.g. I-9's and H-1B LCA public access files) are in good shape as soon as possible.
  3. There are a variety of restrictive immigration bills that have been introduced in Congress in recent weeks that should also be monitored. We do not believe that any of these bills will be passed into law In the near future, but many of their provisions will likely be included in whatever final legislation is enacted.

4. While US taxes are generally expected to fall, there may not be a direct correlation to assignment programs. In some cases, assignment-related tax costs could actually increase. Mobility programs should continue to communicate with the business potential changes and also be prepared to update tax & immigration policies once changes are finalized.
